Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the website, platform, services, and products provided by Mayo Media and Management (“we”, “us”, “our”), an Australian sole trader operating a SaaS platform, subscription service, and content management system.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Eligibility

You must be at least 16 years old to use our services, with the platform primarily intended for users aged 18 and over.

By using our services, you confirm that you meet these requirements.

2. Accounts

To access our services, you must create an account.

You agree that:

  • Accounts are managed by Mayo Media and Management administrators
  • Accounts cannot be self-deleted; deletion must be requested and approved by an administrator
  • Email changes may only be made via administrator request
  • Usernames cannot be changed once assigned
  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activity conducted under your account

We reserve the right to suspend or terminate accounts at any time, with or without notice, depending on the severity of a breach of these Terms.

3. Services Provided

Mayo Media and Management provides a SaaS-based platform and subscription service, which may include:

  • Access to digital tools and platform features
  • Private community and collaboration systems
  • Help ticketing and support systems
  • Channel management and growth services
  • Content strategy and guidance for YouTube channels
  • Future AI-based or automated features

We do not guarantee any specific outcome, including growth in views, subscribers, engagement, revenue, or performance on any external platform. All results depend on external factors outside our control.

4. Subscriptions and Payments

Our services operate on a subscription basis, including monthly and yearly plans.

Payments are processed through third-party providers such as Stripe and Revolut.

By subscribing, you agree that:

  • Subscriptions may auto-renew unless cancelled
  • Pricing may change with reasonable notice
  • Refunds may be requested at any time and are assessed on a case-by-case basis (see Section 11)
  • Early cancellation of a subscription contract may incur a cancellation fee
  • Failure to complete payment may result in suspension or loss of access

5. Access Termination

If your subscription ends, is cancelled, or payment fails:

  • Access to all services is removed immediately
  • This includes tools, features, and community access
  • No grace period is guaranteed unless stated otherwise

6. Acceptable Use

Users agree not to:

  • Engage in hate speech, harassment, or abusive behaviour
  • Share spam or unsolicited promotions
  • Upload NSFW or inappropriate content
  • Attempt to hack, exploit, or disrupt the platform
  • Use bots, scraping tools, or automation without permission
  • Dox, threaten, or expose personal information of others
  • Post content that could harm the business reputation or community
  • Use the platform for illegal or unauthorised purposes

We may suspend or ban users without prior warning depending on the severity of violations.

7. User Content and Communications

Users may interact through:

  • Help ticket systems
  • Private messaging systems
  • Collaboration features between users

Users retain ownership of their content.

However:

  • Users grant Mayo Media and Management a licence to store, process, and display content as required to operate the platform
  • Content is not automatically removed upon account termination unless required by law or at our discretion
  • We are not responsible for agreements or disputes between users

8. AI and Automated Features

Where AI features are provided:

  • AI-generated outputs are for informational purposes only
  • We do not guarantee accuracy, reliability, or completeness
  • Users are responsible for verifying outputs before use
  • AI responses may be incorrect or misleading

9. Marketing Communications

Users may opt in to receive marketing emails relating to updates, features, services, and content from Mayo Media and Management.

Users may unsubscribe at any time without affecting their account or access to services.

10. Pricing, Changes, and Service Updates

We reserve the right to:

  • Change pricing at any time (with reasonable notice)
  • Add, modify, or remove features
  • Update or improve the platform
  • Temporarily suspend services for maintenance
  • Discontinue services entirely if necessary

We are not liable for any loss resulting from changes or discontinuation.

11. Refunds and Cancellation Policy

You are entitled to request a refund at any time by contacting us at mayomediaandmanagement@gmail.com.

Refund requests are assessed fairly on a case-by-case basis, and nothing in these Terms limits any rights or remedies you have under the Australian Consumer Law, including consumer guarantees that cannot be excluded.

Please note that our services depend heavily on factors outside our control, such as platform algorithms, audience behaviour, and content quality and consistency. In most cases, we cannot guarantee that the services will work for your channel or produce specific results, and a lack of growth or results does not by itself entitle you to a refund.

Early termination of a subscription contract may incur a cancellation fee where this has been agreed in your service contract.

12. Account Restrictions

Users agree that:

  • Only one account per person is permitted
  • Account sharing or resale is prohibited
  • Group accounts are only allowed if explicitly approved
  • Beta features may be unstable or change without notice

13. Intellectual Property

All platform content, including but not limited to:

  • Software and systems
  • Branding and logos
  • Website design
  • Training materials
  • Tools and internal resources

are owned or licensed by Mayo Media and Management and may not be copied, reproduced, or redistributed without permission.

14. Confidentiality of Platform Earnings and Performance Data

Users acknowledge that during their use of Mayo Media and Management services, they may access confidential or non-public information relating to their account performance, earnings, analytics, growth metrics, strategies, or results generated or supported through the platform (“Confidential Platform Information”).

Users agree that Confidential Platform Information must be treated as private and must not be publicly disclosed, published, shared, or distributed to any third party without prior written consent from Mayo Media and Management.

This includes, but is not limited to:

  • Earnings generated through the platform
  • Performance analytics and growth metrics
  • Internal dashboards or reports
  • Screenshots, recordings, or reproductions of platform data

Users may share general experiences, provided no confidential or internal platform data is disclosed.

We reserve the right to suspend or terminate accounts if this clause is violated.

15. Limitation of Liability

To the maximum extent permitted under Australian law:

  • We do not guarantee results or success
  • We are not responsible for loss of revenue, data, reputation, or business opportunity
  • Use of the platform is at your own risk
  • Our total liability is limited to the amount paid by the user (if any)

16. Service Suspension and Termination

We may suspend or terminate access immediately if:

  • A user breaches these Terms
  • Behaviour is harmful to the platform or other users
  • Required by law or legal obligation

17. Governing Law

These Terms are governed by the laws of Australia, and disputes are subject to the jurisdiction of Australian courts.

18. Changes to Terms

We may update these Terms at any time.

Continued use of the platform after updates means acceptance of the revised Terms.
